RESOLVED:

 

1.    That Cllr Ballantyne be duly elected as Chairman for the duration of this hearing.

The Chairman invited the Licensing Manger Mr Knowles-Ley to outline the reasons for this hearing and stated that the Premises Licence application submitted by Mr Kaiwani Kadri Nadri of Flat 7 Bayview Court, 8-12 Nyewood Lane, Bognor Regis, PO21 2QG had been the subject of two relevant representations, both in opposition to the application. Of the representations received, one was from a member of the public with the other from Sussex Police in their statutory role as a Responsible Authority under the Licensing Act 2003.

 

Mr Patrick Burke, agent acting on behalf of Mr Nadri outlined the background to the application for the premises licence. Mr Burke stated that they had agreed conditions as stated with police and had no objections to any other responsible authorities. Mr Burke went onto state that within consultation with the police there was no mention of street drinkers. Mr Burke also stated that Mr Nadri had worked in the surrounding area of the proposed premises for six years and had no prior issues of street drinkers. Mr Burke stated that any objecting representations referring to street drinkers to the application for a premises license were speculative as Mr Nadri did not currently sell any alcohol.

 

Mr Crawshaw, a local resident that submitted a representation in objection to the premises licence, outlined his reasons in further detail. Mr Crawshaw stated that his main concern was anti-social behaviour. Mr Crawshaw went onto state that this anti-social behaviour had been ging on for quite a while with street drinkers producing mees and littering in the surrounding area. Mr Crawshaw was concerned that it would get worse if the premises licence was granted with a ready supply of alcohol.

 

The Sub-Committee asked Mr Burke if Mr Nadri had any prior experience in working in any general stores. Mr Burke responded by stating that Mr Nadri had worked in stores previously for months at a time.

 

Summarising statements were given by all relevant parties present at the Sub-Committee hearing. Mrs Di Lauro explained her role in advising the Sub-Committee during their deliberations. Ms Di Lauro also clarified that she would have no input in the final determination and would only be acting in an advisory role.

 

The Chairman stated that the Sub-Committee would retire to have final deliberations and reconvene at 15:45 pm.

 

RESOLVED:

 

The Sub-Committee resolved the application and granted it after a hearing subject to the below. The application is for a Premises Licence for the sale of alcohol for consumption off the premises, every day from 8:00am to 10:00pm by Krakow Market 2A Crane Street Chichester West Sussex.

 

The Sub-Committee was satisfied that the four Licensing Objectives of Public Safety, the Prevention of Crime and Disorder, The Prevention of public nuisance and the Protection of Children from harm would be promoted by the provisions in the Operating Schedule, together with the conditions as suggested by Sussex Police.
